Terms of service
Welcome to freedomoses.com (the "Site"). These Terms & Conditions ("Terms") govern your access to and use of the Site, and your purchase of products ("Products") from Freedom Moses LLC, a Florida limited liability company with its principal place of business at 4000 Hollywood Blvd, Ste 285S, Hollywood, FL 33021-1229 ("FM," "we," "us," or "our").
By accessing or using the Site, creating an account, or placing an order, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use the Site.
We may update these Terms at any time. Changes take effect once posted. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
By using the Site, placing an order, or checking any acceptance box, you agree that this electronic acceptance has the same legal effect as a handwritten signature, and you agree not to challenge the validity or enforceability of these Terms on the grounds that they were agreed to electronically.
1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account or place an order on the Site. We sell certain products designed for children (e.g., kids' slides), but all purchases must be completed by an adult using a valid payment method. If you are under 18, you may browse the Site only with the involvement of a parent or legal guardian.
2. Products and Business Model
FM sells footwear and accessories, including slides, clogs, slippers, and sunglasses, directly to consumers through the Site. We do not currently offer international shipping (see Section 5).
3. Product Descriptions and Pricing
We make reasonable efforts to display Products, including colors, sizes, and details, as accurately as possible. However, actual colors may vary depending on your device's display settings, and we do not warrant that any Product description is complete, accurate, reliable, or error-free.
Prices are subject to change without notice and will be reflected on the Site at the time of purchase. In the event a Product is listed at an incorrect price due to a typographical, technical, or pricing error, we reserve the right to refuse or cancel any order placed for that Product, whether or not the order has been confirmed and your payment method charged. If your payment method has already been charged for a canceled order, we will issue a full refund.
4. Orders and Payment
By placing an order, you represent that you are authorized to use the payment method provided. Payments are processed through Shopify Payments and/or other third-party payment processors we may use from time to time. We do not store full payment card numbers on our own servers; payment information is handled by our payment processor(s) in accordance with applicable data security standards (including PCI-DSS).
We reserve the right to refuse or cancel any order for any reason, including suspected fraud, unauthorized or illegal activity, errors in pricing or product information, or unavailability of a Product.
An order confirmation email means we have received your order request — it does not mean we have accepted it or confirmed that the price, description, or availability of an item is accurate. Acceptance of an order occurs only when we ship the Product to you.
5. Shipping
We currently ship to addresses within the United States only. We do not offer international shipping at this time. Full shipping rates, processing times, delivery estimates, and related terms are set out in our Shipping Policy, which is incorporated into these Terms by reference.
You are responsible for providing a complete and accurate shipping address. FM is not responsible for non-delivery, delay, or misdelivery resulting from an incorrect or incomplete address provided at checkout. FM is not responsible for packages confirmed as delivered by the carrier that are later lost or stolen.
6. Returns, Exchanges, and Refunds
Returns and exchanges are governed by our Return & Exchange Policy, which is incorporated into these Terms by reference. In summary: eligible Products purchased directly from freedomoses.com may be returned or exchanged within thirty (30) days of delivery in unused, original, and merchantable condition via our return portal. A flat handling fee applies to approved refunds (no fee applies to exchanges). Products marked "Sale" or "Final Sale" are not eligible for return, refund, exchange, or price adjustment. Products purchased through third-party retailers or marketplaces are not eligible for return through FM and must be returned to the original seller.
7. Gift Cards
FM gift cards are delivered electronically by email and may be redeemed at checkout on freedomoses.com. Gift cards carry no expiration date and are not redeemable for cash except where required by law. Lost or stolen gift card codes are the responsibility of the holder; FM is not obligated to replace lost or stolen gift cards.
8. Newsletter and Account Sign-Up
By subscribing to our newsletter or creating an FM account, you may be automatically enrolled in our email marketing program. You may unsubscribe from marketing emails at any time using the unsubscribe link in any email or by contacting us.
9. Promotions and Discount Codes
Promotional offers and discount codes are subject to the specific terms disclosed at the time of the offer, are subject to availability, may not be combined with other offers unless expressly stated, have no cash value, and may be modified, suspended, or terminated by FM at any time without notice.
10. SMS Marketing
FM does not currently operate a text message (SMS) marketing program. If we introduce SMS marketing in the future, participation will require your express written consent (e.g., via checkbox at checkout or sign-up), and you will be able to opt out at any time by replying "STOP" to any message. Message and data rates may apply. This Section will be updated with program-specific details if and when SMS marketing is activated.
11. Email Marketing
By subscribing to our newsletter or providing your email at checkout, you consent to receive marketing communications from FM. You may unsubscribe at any time via the link in any marketing email. We may still send you transactional or account-related emails (e.g., order confirmations) even if you unsubscribe from marketing emails.
12. Customer Accounts
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts, refuse service, or cancel orders at our sole discretion, including in cases of suspected fraud, abuse, or violation of these Terms.
13. Intellectual Property
All content on the Site, including text, graphics, logos, product photography, and software, is owned by or licensed to FM and is protected by U.S. and international copyright and trademark laws. "Freedom Moses," the FM logo, and related marks are trademarks of FM. Nothing on the Site grants you any license or right to use FM's trademarks, service marks, or content without our prior written consent.
The Site is intended for your personal, noncommercial use. You agree not to reproduce, distribute, modify, or create derivative works from Site content, or use any automated means (scraping, harvesting, etc.) to collect information from the Site, except as expressly permitted.
14. User-Generated Content
If you submit reviews, photos, comments, or other content to the Site or tag FM on social media ("UGC"), you grant FM a non-exclusive, worldwide, royalty-free, transferable license to use, reproduce, display, and distribute that UGC in connection with our business and marketing, in any media, without additional compensation to you. You represent that you have the right to grant this license and that your UGC does not violate any third party's rights or applicable law. We reserve the right to remove any UGC at our discretion.
15. Prohibited Conduct
You agree not to: impersonate any person or entity; use the Site for unauthorized commercial or promotional purposes; attempt to gain unauthorized access to our systems; scrape, harvest, or use automated tools to extract data from the Site; interfere with or disrupt the Site's operation; or use the Site in violation of any applicable law or third party's rights.
16. Third-Party Links and Services
The Site may contain links to third-party websites or services (including social media platforms and payment providers) that are not operated by FM. We are not responsible for the content, policies, or practices of any third-party site. Use of third-party sites is at your own risk and subject to their own terms.
17. Disclaimer of Warranties
THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, EXCEPT AS EXPRESSLY STATED OR AS REQUIRED BY APPLICABLE LAW. FM DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
Some states do not allow limitations on implied warranties, so some of the above limitations may not apply to you.
18. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY PRODUCT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. FM's AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID TO FM FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.
This limitation does not apply to liability resulting from FM's own fraud, willful misconduct, or gross negligence, or to the extent such limitation is prohibited by applicable law (including certain consumer protection and products liability laws).
19. Indemnification
You agree to indemnify, defend, and hold harmless FM, its officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, misuse of the Site, or violation of any law or third party's rights, except to the extent caused by FM's own negligence, fraud, or willful misconduct.
20. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
Agreement to Arbitrate. You and FM agree that any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Site, or any purchase of Products (a "Dispute") shall be resolved through binding arbitration rather than in court, except that either party may bring an individual claim in small claims court instead of arbitration.
Arbitration Administrator and Rules. Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, available at www.adr.org. If AAA is unavailable, the parties will select a mutually agreeable alternative arbitration provider.
Class Action Waiver. YOU AND FM AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.
Location, Format, and Costs. Arbitration will take place in Broward County, Florida, or, at the arbitrator's discretion, may be conducted by telephone, videoconference, or based on written submissions. FM will pay AAA filing, administration, and arbitrator fees consistent with the AAA Consumer Arbitration Rules; your share of fees, if any, will be limited as set out in those rules.
Opt-Out. You may opt out of this arbitration agreement by emailing info@freedomoses.com within thirty (30) days of first accepting these Terms, with your name and a clear statement that you wish to opt out of arbitration. If you opt out, this arbitration agreement will not apply to you, but the remainder of these Terms will still apply, and Disputes will be resolved as set out below.
If Arbitration Does Not Apply. If this arbitration agreement or the class action waiver is found unenforceable, or does not apply to a particular Dispute (including if you opt out), that Dispute shall be resolved exclusively in the state or federal courts located in Broward County, Florida, and you consent to the personal jurisdiction of those courts. YOU AND FM EACH WAIVE THE RIGHT TO A TRIAL BY JURY in any such action.
Any claim arising from your use of the Site or a purchase must be brought within one (1) year after the claim arises, or it is permanently barred, to the extent permitted by applicable law.
21. Severability; No Waiver
If any provision of these Terms is found unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full effect. FM's failure to enforce any provision is not a waiver of that provision.
22. Entire Agreement
These Terms, together with our Privacy Policy, Shipping Policy, and Return & Exchange Policy, constitute the entire agreement between you and FM regarding your use of the Site.
